The National Transportation Safety Board (NTSB), a Federal government institution charged with overseeing safety on the nation’s roads, made an announcement Tuesday May 14th, 2013 that it believes the legal blood alcohol content (BAC) limit should be reduced from .08 to .05. That means about two drinks for a man weighing 160 lbs and one drink for a woman weighing 120 lbs. Most studies would define a drink as 12 ounces of beer, 4 ounces of wine or 1 ounce of 80-proof liquor.
The NTSB pointed out that over 100 countries have a .05 or lower BAC, and after the threshold for intoxicated driving was reduced to .05 in Europe, the share of traffic deaths due to drunk driving dropped by more than half within 10 years.
Harris County and Houston could definitely use some help reducing the number of deaths and serious injury due to drunk driving. As a personal injury attorney I see a lot of people’s lives severely disrupted due to drunk driving accidents, both from the schedule disruption caused by damage to their vehicle and the problems physical injuries cause. The greater Houston area has a lot of bars, clubs and restaurants and our city is largely designed around private transportation: for the most part if you want to get somewhere, you have to drive.
I support the idea of dropping the limit for intoxication to .05. Perhaps if Houston drivers know that it is easier to pick up an expensive DWI charge they will be more mindful of the amount their drink before getting the behind the wheel. If you have been injured in a car accident caused by a drunk driver, give me a call. I am Board Certified in Personal Injury Trial Law and I take drunk driving accidentsvery seriously. I often file a lawsuit against the drunk driver if their insurance company will not pay my client a good settlement.
