Around 2:30 a.m. a dark-colored Ford pickup truck was traveling west on FM 1960 in Atascocita, occupied by four male teenagers. As they approached the intersection of Timber Forest a Toyota Camry pulled out of a shopping center parking lot, turning in front of the pickup truck and causing a collision. There were four passengers in the Camry, two male and two female. One of the Camry's male passengers, identified in a local news report as Colby Fitzgerald, died at the accident scene. The other passengers were transported to area hospitals, two of them by life flight helicopter. Nobody in the pickup truck was injured in the accident according to Channel 11's report, but the 18-year old driver of the pickup was charged with driving while intoxicated. Despite Colby Fitzgerald's death in the accident, the pickup driver will probably not be charged with intoxication manslaughter because the accident is not considered to be his fault.
